About Taiwan Patent

   Invention Patent, Utility Model Patent, Design Patent
2. Term of Patents
   
   • Invention Patent is 20 years from the filing date
   • Utility Model Patent is 10 years from the filing date
   • Design Patent is 12 years from the filing date
3. Examination
   • Invention Patent：request for examination (can be filed at the same time of filing or within 3 years)
   • Utility Model Patent：formality examination
   • Automatic examination
4. Required Doucments
   1. Specification: (with abstract, claims, and drawings.)
      A copy of the specification in foreign language you filed with the patent application in your or any other country will be sufficient. A4 size is preferable.
      ．Notes: Photos and Drawings are all acceptable for Design. They should cover 6 elevation views (i.e. front, rear, left, right, top and bottom) and at least one perspective view (three-dimensional view) of the design as well as any reference or sectional view(s) that may be helpful to show the design's status in use or its shape. For photos, 7 sets are required.
   2. Basic information:
      • Complete name, address and nationality of the applicant(s) and inventor(s).
      • Filing date and filing number in any other country (at least one foreign application.)
      • If a priority is claimed, it must be claimed with filing.
   3. Automatic examination
   4. Oath
      Simply signed by inventor(s). Faxed copy is acceptable
      Note: Documents and Information may be submitted within 60 days after filing.
   5. Assignment (if the applicant and inventor is not the same one)
      Simply signed by inventor(s). Faxed copy is acceptable.
   6. Power of Attorney
      Simply signed by applicant(s) or representative of the applicant.
   7. Certified copy of Priority (if priority is claimed)
      • An applicant shall simultaneously make a declaration by indicating the name of the country in which the first patent application was filed and its filing date, application number.
      • The application number of the first patent application can be supplemented. The certified priority document shall be submitted within 16 months for invention and utility model application from the earliest priority date. (within 10 months for invention)
   8. Certificate of Corporation
      If the applicant is a juristic person, this document may be needed. We advise the applicant to provide us this document if the applicant never filed a patent application in Taiwan before. This document must be notarized (Legalization is not required).
   9. Chinese translation of specification
      Can be submitted within 4 months from the filing date. We will prepare the same.
5. Patent Procedures

About Taiwan Trademark

1. Categories of Trademarks:
   Trademark, Collective trademark, Collective membership mark, Certification mark
2. Term of Trademark
   Its 10 years from the date of publication of registration.
3. Renewal of registration
   • The period of the trademark right may be renewed, and the duration of each renewal period shall be 10 years.
   • A request for renewal of the trademark right shall be made within 6 months before the expiry of the period of the trademark right; failing this, the request may be made and the fee paid in double within such further period of 6 months from the day following the date of expiry of the period of the trademark right.

5. Required Documents
   
   1. Power of Attorney
      Simply signed by applicant(s) or representative of the applicant
   2. Specimens
      10 specimens (in the size range 5 cm x 5 cm～8 cm x 8cm ) of the trademark. Color trademark is registrable. We could prepare these based on your original copy.
   3. Basic Information
      • Complete name, address and nationality of the applicant.
      • List of goods or services to be protected and class (if available) to be registered.
   4. Certified copy of priority (if priority is claimed)
      • An applicant shall simultaneously make a declaration by indicating the name of the country in which the first trademarks application was filed and its filing date, application number.
      • The application number of the first trademark application can be supplemented.
      • The certified priority document shall be submitted within 3 months from the filing date.
   5. Certificate of Corporation / Nationality And Use Affidavit
      Simply signed by applicant or representative of the applicant. This document can be submitted within 30 days after filing (extendable for another 30 days.) They are not required for the application but frequently requested by the Intellectual Property Office (IPO). We strongly advise the applicant to provide us this information as a standard procedure.
